General Terms and Conditions (AGB)

TERMS & CONDITIONS


1. GENERAL PROVISIONS

  • 1.1 Extraordinary Termination: The facility reserves the right to terminate any membership or pack with immediate effect and without refund for severe violations of house rules or disrespectful behavior.
  • 1.2 Operational Closures: The facility may close on public holidays and for up to 14 days per calendar year (e.g., maintenance) without entitling the member to a refund.
  • 1.3 Upgrades & Downgrades: Upgrading to a higher plan is possible at any time. Downgrading is only permitted at the end of the regular contract term.
  • 1.4 Personal Membership: All memberships and packs are strictly personal and non-transferable.
  • 1.5 Adjustments: NWFit reserves the right to adjust schedules and prices. Changes will be communicated 1 month in advance.
  • 1.6 Class Cancellations by NWFit: A minimum of 2 participants is required. If canceled by the facility, the class credit is returned.
  • 1.7 Special Offers: These T&C fully apply to promotional memberships (e.g., "Founding Members"), unless explicitly stated otherwise.
  • 1.8 Jurisdiction: Governed exclusively by Swiss law. Exclusive place of jurisdiction is Nidwalden, Switzerland.


2. MEMBERSHIP RULES (Beginner & Regular) Duration & Renewal:

  • 1-Month plans auto-renew. 6- and 12-Month plans expire automatically and do not auto-renew.
  • Payment & Commitment: 6- and 12-Month terms (whether paid upfront or monthly) are binding commitments for the full duration. Early cancellation, prorated refunds, or stopping monthly payments early are strictly prohibited.
  • Class Cancellation (No-Show): Free up to 24 hours prior. Later cancellations or no-shows result in a lost credit.
  • Holds: Vacation holds vary (1-Month: none; 6-Month: up to 2 weeks; 12-Month: up to 4 weeks). Medical holds (>3 weeks) require a certificate.


3. CLASS PACK RULES

  • Validity: Valid for exactly 3 months from purchase. Unused credits expire. Fixed-term package; no early refunds. No vacation holds permitted. Medical extensions (>3 weeks) require a certificate.
